Often a party will seek an emergency TRO and this is decided by the judge based upon the pleadings before him/her. The fact that they did not seek an emergency TRO tells me there will be a response filed and a subsequent hearing.Does the university have to respond before the judge ruling on the TRO?
Or is just simply the judge ruling without additional input.
Well this bodes well if I’m correctly applying it to the entire situation.
I don’t like your conclusion, but your logic seems sound.Love TSJ, hope he is innocent and can get back on the court ASAP, but not really a fan of this latest development. The lawyer claims TSJ was treated unfairly, and while you can argue against the university policy in place, it seems it was followed to the letter and thus TSJ wasn't given any different treatment otherwise. Unless I'm missing something, there seems to be no factual evidence that the university did not follow their process. I also understand the argument saying that TSJ isn't getting his due process and that his presumption of innocence is not being respected, but this also isn't happening in a court of law, it's happening within a university that has it's own code of conduct that is agreed to by students/athletes upon their acceptance of admission. Unless there was some outrageous violation of TSJ's civil rights embedded within the university's code of conduct, my assumption is that a court is not going to bother adjudicating these types of matters.
That said, if this temporary injunction/restraining order is granted, I don't see any scenario where TSJ actually plays as the risk is simply too great with the case still active. Consider a scenario where this order is granted, TSJ plays, and then a week later new evidence comes to light that is not favorable to TSJ. I think the only way TSJ suits up again for the O&B is if the case is dismissed.
His ability to play takes away all of her leverage. I think that the DA took it this far because she thought TSJ would fold and settle.I’m a geographer and not a lawyer, but is there a chance the TRO increases the exposure for the DA and could accelerate the dropping of charges?
...but I think the overriding issue in TSJ’s favor is he is suffering great and perhaps irreparable harm being suspended whereas the university suffers no harm if he’s reinstated.

Seriously? Let's refocus on who's actually being piled on right now. Who has the most to lose? It's not the school. Not a big fan of the defamation suit idea. If this by some miracle all goes away (meaning TSJ is innocent and generally re-accepted in the court of public opinion), then you just let it lie. Bringing it up again in a lawsuit seems not the way to go; this woman probably does not have substantial assets. Could be seen as piling on, especially to people out there who will never believe him under any circumstances.
No we dont.
We need to start a #freeTSJ movement. The court of public opinion is a very real thing. Us having a very active and loud fan base is also a VERY real thing. Can you imagine what this poor kid has been through? Get this out on social.
How anyone can file charges based off of that is just damn crazy

Why the hell did she Google Kansas State basketball roster? Did she not even know what university she was at?

Wow, if this is all true, someone for sure needs to be in jail, but it is not TSJ! Holy cow, that's some ridiculous profiling to get someone in trouble, or get that bag!

Holy hell, what a trava-sham-mockery!

Wow. Not a great look for the DA or the accuser.

Is this information a summary from the police report made public by the restraining order filing? Or is the report public now? I'm a little confused by that. Both the victims story along with TSJ's are out there now. So frustrating that it has come to this, should never have gotten to this point.
