Interesting article. The author, a professor in the College of Labor and Employment Relations at UIUC, reviewed an NIL contract from a BIG Ten school and an NIL contract from an SEC school that he FOIA'd. Author believes the Big Ten contract has the athlete give more ownership rights of their image to the conference compared to the SEC contract.

Specifically this clause appears in the SEC contract, "Notwithstanding the foregoing, Institution shall not obtain ownership rights, other than the license granted in this Agreement, in or to Student-Athlete’s Likeness.”

Conversely, the author notes the Big Ten contract states, "[t]he athlete grants the Big Ten 'Institution the irrevocable, exclusive … royalty-free, fully paid-up sublicense through multiple tiers… including the 'Athlete’s name, nickname, pseudonym, voice” and more than 10 other identifying aspects of the athlete.'" He continues, "The 'multiple tiers' language (very open-ended) separates the athlete’s publicity rights from a purely athletic connection that appears in the SEC contract."

I have no reason to contest the author's sentiment that the SEC contract is more advantageous to the athlete by allowing them to keep the rights to their name and image in non-athletics arenas. If I'm giving to an NIL collective, I would want the rest of the NIL contract to be competitive with the other conferences and not just the up front payment.
