This a rule going forward. These people want it apply to them retroactively. It seems clear to me. It makes you wonder how they come up with their rules and whether they even talk to the lawyers beforehand.
I give the NCAA a 20% shot of winning here (don't try and bet me though). The one area they seem to have some deference with the courts is eligibility, so my uninformed opinion is to give them a chance of prevailing.
When I was at certain large corporations which I won't name, the executives would tell the lawyers or consultants what the outcome they were expecting was. Then surprise, surprise, that's what they got, regardless of it's efficacy.
