The difference between your typical extracurricular activity and job is that the former is of predominant benefit to the participant, whereas the latter benefits the employer quite a bit, which justifies compensation.

Students don't get paid to participate in stuff like glee club. They do get paid to work in the library. Why the difference? Glee club's primary benefit is to the kids who participate in it. Working in the library however benefits the university.

Clearly the university benefits from the revenue and media attention brought in by student athletes. And still doesn't pay them btw. Now, finally, athletes are merely not prohibited from seeking off the court compensation. Which by the way has never been a prohibition faced by students on academic scholarships.

Not paid? Ask the student who takes out multiple loans to pay for school. How much is room and board, tutors, tuition and fees, etc. if you add it up 25,000 a year
I was a 4 year varsity athlete at U of I , it was the best 4 years ever. NIL is great for the athletes, especially for those who the University uses for the face of the sport. I would also point out that star athletes particularly in man’s basketball and football get their faces on national TV that allows them to sign the contacts they sign in the pros. It benefits everyone. They also have access to one of the best Universities in the country for an education-that is something.

In the pros, a player gets paid for the performance a team projects they'll get on the court. The same player can get paid to be a brand ambassador for a company as a function of their popularity, which is also largely based on their play on the court. They're both based largely on performance. It's a distinction without a difference.

In the NCAA the only difference is the teams can't pay them directly, so the only way a players value is realized is through endorsements.

That's just not true. The player endorsement money includes the persona. and it has dramatically steep curve that pays the best and most marketable players.

Regardless, they are two different criteria. One payment comes from the team based on performance. The other comes from a company based on how that player helps them sell products. Each has its own measurement.

In college now, the college pays nothing and then we have created this NIL process. The lawsuit was to allow student athletes to use their name, image, and likeness to generate income. The process has moved well beyond that and they are using the NIL structure to get paid for performance.

say hello to the 2008 real estate crash. There is market value and then there is inflated disaster waiting to happen market value. Those driving the market to the disastrous untrue levels (smart attorneys/agents/accounts), give two S&^$s if it destroys the market as long as it lines their pockets in the process.

Market value is market value, whether it’s faulty or not. Now… is, say, a Coleman Hawkins endorsement for a bank worth $500k? That’s for the bank to decide. It may discover that it was a foolish investment or it may greatly increase its business. But regardless, the market value for a Coleman Hawkins endorsement has been set.

They aren't even doing endorsements. They are just giving them money.

And market value is not what the market is paying necessarily. There are all sorts of distortions to the market that are recognized under law in many ways. This is a classic case where a person is willing to overpay for something just because of their desire to help the person.

I've been saying this the whole time. NIL will only be a huge benefit to the students if people pay above the actual value the player has to them because they want to help Illinois basketball.

There are some shenanigans going on in those NCAA numbers. There has been much debate here in CA about how much the athletic department should give back to the UC system. Also check out these numbers from UIUC budget for 2019. Football netted 30M and basketball netted 10M. And this was supposedly COVID effected.

The market has said for decades that some of these athletes are worth more.

The point is that they should get their market value. Just because you did not does not mean they shouldn't be able to.

...and bringing this back to recruiting. Our school is doing well in this environment! We're more relevant under NLA than we've been in 15 years...not sure why folks are upset.
