Not a criminal lawyer, but it sounds like it’s pretty rare for a case to get dismissed a the prelim hearing stage.

That said, this DA is certainly sideways with the Bench and I believe the judge hearing TJs case has given public remarks how upset she and the chief judge are that the DA impugned his character, that there is a huge level of distrust between the Bench and the DA’s office etc.

With that background, and what seems like a weak case on paper, I can see a Judge in a borderline case either a. consciously deciding if there is a plausible way to put egg on the DA’s face, she’s going to do it or b. unconsciously having that distrust with the DA, in a borderline case giving the tie to the Defendant.

We will see. But in my uneducated opinion TJ has a decent shot of winning the prelim given the lay of the land. Don’t go around honking off Judges, kids.

Right on the point what the he!! Is expedient 2 months? It seems to me that the federal system has no idea what to do here? I know mountains of paper work were thrown at them, but is that not common in any case that could set precedence? One week, it would appear to the normal individual (non lawyer), starts to make the term expedient irrelevant?

I have a bad feeling that the judge is waiting till Friday afternoon, the typical time for a bad news press release, ro release her ruling.
A "bad news press release" by her/press standards would be granting the TRO that allows an **alleged** perpetrator of sexual assault to resume playing college basketball. We can all think/believe what we want around here, but by far the less positive public reaction would be that ruling versus the alternative.

So if indeed that's what she's waiting for (color me skeptical, personally) that shouldn't garner a bad feeling for those who believe TSJ should be able to play. Quite the opposite.

I think broadly a decision to grant the TRO would be viewed as an unpopular decision. There is a small subset of Illini basketball fans who might view it a different way, but not allowing a school to suspend a player with these serious charges pending is the reason you might slip it in late on Friday I would say.

Take a look at the Zoom photo that Dan posted from Scott Richey's article. I think it's ominous looking at that the image from the DCSO (Douglas County Sherriff's Office) Correctional Facility video (lower right) in the same video conference with Terrence Shannon (upper left). There are several big matchups coming in this next meeting on 2/23. The most obvious one will pit Mark P. Sutter (upper right) and Tricia Bath (lower left) against DA Suzanne Valdez and however is assisting her (maybe again Asst DA Brian Dieter, who was also in the 1/18 meeting, but wasn't in the photo).

Another part of a long-waged battle will continue between Judge Sally Pokorny and DA Valdez. The fact that these two women don't like working with each other, and, seemingly, don't like each other, could be a good thing for TSJ. The real question there is, could that growing bad blood help Shannon and his lawyers persuade Pokorny that there isn't probable cause on one or both charges on 2/23. Regarding the bad blood, it shouldn't work that way, but I wouldn't be surprised if it did.

The longer this goes the more I think the judge is considering ruling in TJ’s favor

To the attorneys just checking out of the ubiquitous Holiday Inn - what are the odds the judge throws out the rape charge but keeps the other charge?

Will Judge Pokorny remain the judge for the duration of the case? It is also interesting (and perhaps not unintentional) to see the picture of women's rights champion RBG in Tricia Bath's office.

Shannon hasn't missed any games that he probably wouldn't have anyways (unless you expected the judge to rule over the weekend within a day or two of the hearing), so it's not that big of a deal that she's taking her time to get it right. To live up to the urgency and her stated goal of ruling expeditiously, I'd hope it comes today, though.

Agree, however, I have to believe if Terrance is found guilty of this, then a larger issue is why Whitman allowed him to play at all this year.
So, if a TRO is granted, it would seem to signal that the case against him is weak.
