Kind of the way this case has been looking to go for about the last month.

Hope to hear that Jaylon's been reinstated to the team in short order, and that Jaylon can move past this and have a great senior year both on and off the court.

I also hope the victim (and I do believe that she was a victim, but that Jaylon wasn't the perpetrator) gets any help she may need and has a happy and safe finish to her time at U of I.

per Bret Beherens Tate's case dropped, dismissed

This is wonderful news! When Tate was arrested for domestic violence, I honestly couldn't believe it. He seems way to passive (both on the court and off) to ever hit someone, much less a woman. Nunn's arrest wasn't a huge shock, because he has exhibited some overly aggressive tendencies on the court. It seems like he has a bit of a temper.

@WCIA3Bret

Tate's attorney Evan Bruno: This case is over today because Jaylon Tate never did anything wrong in the first place."

@WCIA3Bret

Bruno: "It’s not that there wasn’t enough evidence to prove his guilt; it’s that there was overwhelming evidence to prove his innocence."

@WCIA3Bret

Bruno: "This charge was based on nothing more than unsubstantiated college gossip." #Illini

With Klondike, invisible man and other lawyers on here, myself included, there must be a lull in legal work lately. Glad to hear Tate's case was dismissed - by all accounts the allegations were completely out of character. I hope he gets his game together and has success in his senior season (and doesn't about rip another finger half off or something).

I think his case being dismissed is bad news for Nunn. Ay best, I think Nunn is suspended for next year (and perhaps loses his scholarship for next year if Groce can find someone to give it to) and is maybe allowed to return the following year if he keeps clean and wants to wait around to play.

Really, really glad to see this happen. Disappointed that stupid kids are stupid.

But mostly glad for JT, and not having to have this hang around his neck for the rest of his life.

Great news for Jaylon, just sucks that he had to have his name drug through the mud to get to this point (of which I am admittedly guilty)

As expected. Good news. Another senior, experienced, pg can never hurt. Even if Tate hasnt been super great up to this point.

Great news for that young man. Hope things work out for Tate, in his final year at Illinois.

Does anyone have an idea how much the Tate family will have paid to fight their way out of this?

I am going to go easy on your question- Why would you ask that?

This family has been through hell and back- Time to quit dissecting this case.

No where close to what a 4 year scholarship with room,board, and stipend cost. What ever it was it was worth it. Not sure they will pursue civil suit if truely Tate was not involved in any way or contributed to the assault.

So much for the prosecutors don't proceed with cases unless they have good evidence pablum thrown out by several attorneys on this board...prosecutors proceed with garbage cases all the time...Brady v. Maryland is the most ignored case in any SA's office in any county in Illinois....this case was nonsense from Day 1 yet the experienced prosecutor dragged this kid through the mud and fortunately choked on the marginal evidence when Tates counsel rightfully rejected a plea agreement....good for Jaylon

“I don’t know what happened, and if I and my staff don’t know ourselves what happened, we can’t ask a jury to find someone guilty beyond a reasonable doubt,” Rietz said.

That Rietz could say this, and yet up until this afternoon was intent on taking the case to trial just amazes me.

Been watching this with interest since inception. I'm an aged attorney but in the realm of taxes; I know crim law no better than my mailman. But from pretty early on this seemed headed for this result. Frankly, it appears the young lady, after sobering and lawyering up, intended for this result -- get JT off due to his innocence but for whatever reason (and I hope it's a good one) not have the person responsible for her injuries prosecuted. Only question now is where does JT go to get his reputation back. Rietz could have helped with that but did not.

Nonsense from Day 1? Easy to say from the comfort of your sofa. But let's suppose that you are a prosecutor. The cops bring you a case: woman showed up a the hospital with a busted lip who told three separate people that her boyfriend/husband/whatever assaulted her. Shortly thereafter, she decides she doesn't want to proceed and stops cooperating. What do you do?

Yeah, I know the answer: dismiss the case, right? Except, what if this basic fact pattern repeats itself in half of the domestic violence cases that your office deals with? And you know that in the majority of them -- not all, but let's say 90% -- the victim is recanting because she's terrified of what will happen to her if she goes forward, not because the assault never happened. Is your answer still the same?

Look, everyone is want to bash prosecutors and accuse them of unethical conduct just because they lack the magical ability to know the truth or falsehood behind every contested allegation. In practice, they can't just fold up the tent every time the proof is less that indisputably rock solid. Do that and you'll be criticized even worse for being soft and allowing crime to run rampant. So they do what they can, proceed until it becomes clear that the case is a loser. Granted, the process may take longer than it should and maybe that's what happened here, but there's a world of difference between being too slow to reach the final resolution and deliberately railroading innocent people.

The bottom line here is, the case WAS dismissed. Tate was not tried on a charge that could never have been proven beyond a reasonable doubt. That's how it's supposed to work. As far as the "dragging his name through the mud," I don't recall the SA's office ever making a statement about this case that wasn't a reiteration of the information provided them by the police department or witnesses. There are more outcomes in the criminal justice system that just "guilty person convicted" and "innocent person wronged by corrupt prosecutor."

I won't go easy on your response. What is wrong with the question?

As per usual, crickets from the national media on Tate getting cleared. Feel bad for him.

What exactly do you expect, first page on CNN?

Many outlets have already reported the case against him has been dropped.

There's nothing wrong with that question. It is a legitimate one seeing that it appears extremely unlikely that Tate committed this crime, yet his family could have to shell out thousands of dollars for his defense?

They didn't proceed.

None of the attorneys here said prosecutors don't charge nonsense with regularity.

No, but they did say that shes an experienced prosecutor who wouldnt go to trial without a winnable case....she had a garbage case and kept it alive in hopes of a plea...this is standard operating procedure for a great many prosecutors....I have seen it more than I care to remember in the many criminal cases I litigated in Illinois...and a lot worse, especially in Cook County
