Not a great analogy. For one, there are laws requiring a pool to be fenced in Illinois and many other states and local municipalities. I haven't heard any indication the UM tunnel was not up to code. Second, none of the scenarios you mention involves a clearly at-fault third party. How about this analogy instead: you host an annual pool party and invite your neighbors, including Bob and Jim who you know absolutely hate each other, and even got into a shouting match at last year's party. Your pool only has one set of stairs and while Bob is using it to get in, and Jim is using it to get out, they get into an altercation and Jim drowns Bob in your pool. How liable are you for Bob's death?

Actually, you didn't invite Bob or Jim. The homeowners' association invited them.

Good Lord!! Those people are complete asshats. I used to tepidly root for Michigan State in football (just to piss off Michigan), but I hope those thugs and their psychotic fans never win a game again in any sport. Their entire board is composed of losers and idiots. Let's beat these turds by 50 and kick their fans asses back to Michigan. I am beyond shocked by the degree of lowlife posts on that site.
Its a nice reminder that while we (the Online Illini) are a particularly spazzy bunch, we never stoop to the depths of depravity as these Michigan State posters are doing. I even saw a Michigan State fan on a politics message board ranting about how the Michigan players got what was coming to them. Excuse me??? I really hope we can put them in their place this weekend. Memorial Stadium doesn't have any tunnel problems that they can blame for their loss...

Yeah, not a lot of “Our guys were in the wrong. We need to deal with the consequences and move forward making sure this type of thing never happens again” in the online portion of the Sparty fan base.

To be fair, I saw one post with this sentiment and it had a lot more likes than any of the ridiculous posts. Could be a case of the silent majority understanding that but not wanting to engage the psychos.

A couple years ago I moved a few towns over and the new area didn't require fences around pools and it absolutely threw me off.

How about this as an example: A gas station in a seedy neighborhood has been robbed at gun point 4 times in the last year but the owner doesn't install a plexiglass shield. Then an employee gets shot. Hard to imagine there isn't some liability on the owner there.

I hope so, my wife has family in Michigan, and if the whole state is like that I fear for their safety.

Sure there would be under workman's comp because it's an employee and it honestly doesn't matter if it's happened before. And again, these hypotheticals are kind of nonsense because the thing that happened at UM hasn't really happened before anyway. The Penn St. and OSU incidents were verbal altercations plus a peanut butter sandwich.

And even in your scenario the owner has no legal duty to install a shield. Might be a good idea to avoid some of these workman's comp claims, but it's not negligence to not do so. I mean what if there is a shield, but it's now a customer that gets shot? Did the owner have a legal duty to employ an armed security guard? What if the security guard gets shot? Should the owner have installed a metal detector at the entrance? Lack of extra security measures is fundamentally different than a hazard, like a janky step or a loose railing.

Michigan had both active and constructive knowledge of tunnel issues - I've said before, they have potential problems. There were issues before but it could be argued James Franklin put them on notice.

Well, yeah, friendly and civil at the pool parties. It was when he fished our car keys out of the bowl at the key party later in the year that I found my attitude toward him darken dramatically.

The Homeowner's Association strangely lacked any language concerning such an event in its bylaws.
