Mbwake will be the best comparison for Thorne and that will work in our favor since hardship applications start in the conference. Mbwake also is an exception to the 4 in 5 rule as of course so are Eschmeyer and Settles.

Yes, although Trevor Mbakwe is a different case. His sixth year was not due to 2 injuries but to compensate for an involuntary redshirt due to a pending assault case.

Forgot about that. But it really shouldn't matter much since both are involuntary.

a) The incapacitating injury or illness occurs in one of the four seasons of intercollegiate competition at any two year or four year collegiate institution or occurs after the first day of classes in the student athletes Senior year in high school.

That waiver also states the 30% of the season factor and does not say anything about differentiating about February, December or March.

Well, the injury has to be incapacitating, if you're playing in November, December and then again in February and March, that probably doesn't qualify.

You petition for a 5th year after you've been there for 4.

If it's an injury red shirt, you apply for it at the end of the season when the injury occurred.

I find it interesting that Mbakwe got a decision from the NCAA on March 23rd and here we are a month later on Thorne and TA and no decision.

Personally, I think where Thorne gets screwed is his injury occurred in the fifth year plus he had another in his first year. NCAA has no provision for 2 season ending injuries nor for one that ends in the fifth year. TA's case does technically involve an injury in one of the four seasons but also has an injury in the fifth. Jess Settles was the only 6th year guy I could find, but his injury occurred in one of his first four years.

It says the injury took place in one of the four seasons of competition. It does not say the first four seasons. The Mbakwe sixth year seems to show it does not have to have happened in one of the first four years. If you do not play in a year, or if you get a redshirt after playing in part of a year, I think that year does not count as a year of competition.

Tracy's second injury occurred during his fifth year at Illinois, but I've not heard anyone argue he does not qualify.

Not confirmed, but incredibly likely. He still has to go through the process. I think it was Dakich who called out the NCAA every time Tracy was on camera saying that if he doesn't get a 6th year, the NCAA should be ashamed.

While I'm sure the NCAA is incapable of feeling shame, I do think that they will grant TA his waiver.

West red shirted as a freshman due to academic requirements, then tore his ACL last year in the first game.

Well, that is not a good sign. :mad: Over the course of my fandom, I have come to the conclusion that nothing the NCAA does is ever a precursor to what they will do when exactly the same instance happens again. :thumb:
