Last thing I’m going to say since some of you seem to know exactly why TJ was charged….all the sexual acts were consensual when the happened, TJ in no way forced his hand down a females pants nor did he force hers down his…... I won’t be commenting on this til TJ has his day in court or some other resolution happens.
Thank you for all your info on this. I (and most of us in here) know you have a lot more info than we do and you’re trying to tip toe around saying certain things. From the tea leaves I’ve read I hope Terrence gets his day in court and is proven innocent which I believe he is. I also hope (although less important) TJ is back on the court soon. If that day comes and we see him suit up I will be at the first home game to show him how much Illini nation loves him and has his back. If that day comes I hope to see a lot of my friends there cheering loudly for him. I can only imagine what that young man has endured the last 3 days.

I have followed this page since the beginning and I really am not seeing anyone on here wishing to punish TJ. What I DO see is many posters trying to punish the accuser before any of the facts come out and claiming TJ's total innocence.
Unfortunately, I think there are many here who’s desire for a Final Four / National Championship clouds their vision. I do not know the facts. I do not know if TSJ is guillty or innocent. I do know I am about to be 63 and I want to see a National Champion Banner hanging from the rafters SFC before my time is up and I think with TSJ this team has a chance to accomplish that. I really really want that NC. But I don’t want any taint on that banner like say, the one hanging in the Dean Dome for the 2004-2005 season. God, I hope TSJ is innocent. But if he isn’t and we further victimize a victim because we want to win sooo bad ? Well I can’t go there. Let justice be justice. This ain’t about basketball.

Some on here read it that way, but from what I read, any misrepresentation -- presenting yourself as wealthy and using that to intice your partner, for example -- could get you charged with rape if your partner found out you were actually poor and got upset. They could say you misled them, thereby meaning they couldn't consent since they didn't have all the facts
That is about the only way to square what 0440 was saying when you look at that law.

Take the most ridiculous, extreme, imaginary example that I could think of... Joe Schmo wears an incredible disguise, tricks a married woman into thinking he is her husband, and then sleeps with her. Pretty much everyone would say that's rape. But how would a Kansas prosecutor file that case under this statute? I think they would try to shoehorn it in under the force/fear prong... unless there are other Kansas rape statutes that would apply that have not been posted here, obviously. The other prongs (unconscious, mental disability, intoxicated, minor victim, unethical doctor, unethical prison guard) would not apply.

I will say that I do have a hard time believing a prosecutor would file a felony charge based on a "I thought he was a football player" complaint, as much as I hope TSJ is innocent. But we shouldn't have to wait too long to hear something from the court.

Don't have a hard time believing such things from a prosecutor's office! Long story short, but I once had a case where the prosecutor charged my client with felony theft when the money belonged to him, and I could recount several more cases equally ridiculous.

I don't mind the bourbon/whiskey/liquor talk.... a nice distraction, and necessity under the current happenings! I've often thought about starting a separate thread for those of us who imbibe to share our experiences.... its seems there are plenty of us to share our pleasures!

(1) actual fact patterns will cleanly map onto statutes; or
(2) you can reverse engineer from a relevant statute to a detailed and accurate fact pattern

have never practiced law.

I don't, because I'm sure this happens more frequently in a college town. It's just that most women likely take the L on being able to say they hooked up with a certain kind of athlete instead of escalating it to this point.

Note, I'm not trying to minimize how she feels. She may genuinely feel violated because of this. It doesn't cross my threshold for feeling violated, but that doesn't mean it doesn't cross hers, odd as I find it.

You have it right. The statute https://www.womenslaw.org/laws/ks/statutes/21-5503-rape#node-51707 outlines five acts that will be considered rape: 21-5503(1) is one of those five, and the only one listed in the warrant.

The situations involving misrepresentation are set out as different cases under 21-5503(4) and (5). The copy of the warrant that has been circulated here does not charge him with violating either of those.

(Fwiw, I am a lawyer, but my only legal experience that is pertinent here is familiarity with how statutes are structured.)

I hope that this is just an unfortunate incident by 2 people drinking that got blown out of proportion and that there was no rape. Even if it is damage has been done to TJS. If he were reinstated while this plays out I can hear the nasty chants in every arena around the Big. I still pray for both TJS and the young lady too that the truth will come out because in either case guilty or not both lives will be forever changed.

I want players to have due process and not get punished before the legal system weighs in. If the next court case is 18 Jan that probably means the grand jury won’t occur for a few months. Too many people lives have been ruined by not letting the legal system work and having social justice take over

No one isn’t saying this isn’t serious and an ideal world the case could be presented this week but that is not how the system works.

Would an average student be kicked out because they were charged? I don’t know the answer to that but if the average student would be able to continue at the university then it is not like TSJ is getting special treatment

I am not "wishing" to punish him, but I do think SOME punishment is required to uphold the existing zero tolerance policy. (I don't think that punishment MUST NECESSARILY BE "suspend him until the legal proceedings are resolved," particularly if the panel has evidence that convinces them that the Kansas DA is unlikely to be able to prove a felony.)
