IANAL BIDSAAHILN
IANAL but it is cold today.
Introduction
Petitioner, Texillwek, hereby moves the court for a temporary restraining order against Mother Nature, seeking immediate relief from the unreasonably cold weather conditions that have been plaguing the community. The following memorandum of points and authorities supports this motion.
Facts
- The temperature outside has been consistently below freezing, causing significant discomfort and inconvenience to the petitioner.
- The cold weather has led to hazardous driving conditions, making it difficult for the petitioner to travel safely.
- The petitioner's home heating system has been unable to keep up with the extreme cold, resulting in higher heating bills and inadequate heat.
Legal Argument
Negligence
Mother Nature, as the primary force governing the Earth's weather patterns, has a duty of care to maintain reasonable and safe weather conditions for the petitioner and the community. The excessively cold weather constitutes a breach of this duty, causing harm to the petitioner in the form of physical discomfort, financial burden, and emotional distress.
Public Nuisance
The cold weather, by its very nature, interferes with the public's right to use and enjoy public spaces. It has become an obstruction and interference to the petitioner's use of public roads, sidewalks, and other outdoor areas.
Private Nuisance
The cold weather has also become a private nuisance, substantially interfering with the petitioner's use and enjoyment of their property. The petitioner is unable to engage in outdoor activities or even leave their home without experiencing significant discomfort.
Relief Requested
The petitioner respectfully requests that this court issue a temporary restraining order against Mother Nature, enjoining her from continuing to subject the petitioner and the community to unreasonably cold weather conditions. Specifically, the petitioner requests that the court order Mother Nature to:
- Raise the temperature to a more comfortable level, allowing the petitioner and the community to enjoy outdoor activities without undue hardship.
- Improve driving conditions by melting any ice or snow that may be present on roads and sidewalks.
- Ensure that the petitioner's home heating system is able to adequately heat their residence, reducing the financial burden associated with higher heating bills.
Conclusion
In light of the foregoing, the petitioner respectfully requests that this court grant the temporary restraining order against Mother Nature, providing immediate relief from the excessively cold weather conditions.
Ohhh, that's what that meant.Do you really want to see IANAL splattered throughout the thread?
Agreed. There could be various ways this played out and one scenario is she could be mistaken on who did it instead of being a liar out to ruin the life of someone she's never met before. It was a damn good, reasonable read.
I appreciate it.

MeTV Channel (Channel 77 DirecTV)I used to watch a lot of the Perry Mason shows when it was on , so I think, even though I am NOT a lawyer , that I have a good understanding that TSJ is innocent and should be reinstated immediately based on the fact that he is innocent of all charges and he should explore the premise of suing the accuser and the Douglas Co. DA for defamation of character.................
I really really do.....................

This cannot be overstated enough. When you consider 12% of the people who have been sentenced to death row were later exonerated, and in those cases, close to 70% of those wrongful convictions were due to misconduct by police, prosecutors, or government pressure, not having the means to adequately represent yourself is a scary proposition.thank God that Shannon has the means to afford excellent representation
I found it very entertaining back in the day and I will have to check it out.......I use Hulu Live + so I will probably have to add the streaming channel after the fact .....thanks bro..............MeTV Channel (Channel 77 DirecTV)
Still on..........and I still watch Perry Mason.
The Kennedy Assasination and the DB Cooper case remain elusive. As to Jimmy Hoffa…not sure where they buried him after they stole his DNA to clone him. (Exhibit A)Well, I have 4 nights at a Holiday Inn Express this month....with 4 more to go so.....not a lawyer, but there's a solid chance I solve cancer, the Kennedy assassination, Hoffa's location, and the DB Cooper case in the next few weeks.

As for how victims actually respond, you’re correct … but you’re speaking to ONE problem with tunnel vision and acting as if consideration for that problem is the only moral high ground you can claim here.If you are triggered by me saying that people should better educate themselves about the different ways that sexual assault victims respond in different situations, and just because they didn't respond the way you think they should doesn't mean an assault didn't take place, then you are part of the problem.
And if me saying that upsets you, I really don't care.
I also want to point out that my original post was not making a statement as to what I think happened with TSJ. I hope that an assault didn't occur. But I don't know. None of us do. However, my post was making a general statement about how people respond to sexual assault (and sexual assault accusations).
I clearly did not think through all the potential acronyms. Clearly INAA. (I’m Not An Attorney).Do you really want to see IANAL splattered throughout the thread?
Again, my statement was not in reference to the TSJ situation. I still don't know why people are upset at a suggestion that people should better educate themselves. As for how victims actually respond, you’re correct … but you’re speaking to ONE problem with tunnel vision and acting as if consideration for that problem is the only moral high ground you can claim here.
Meanwhile, it appears clear as day to 90% here that this case is a big pile of BS. Therefore there’s rightfully plenty of outrage toward the DA for the pain she’s caused TSJ based on how flimsy the evidence is (if you can even call it evidence).
Not a lawyer but I work nextdoor to the School of Law. I am lawyer adjacent.Everyone now needs to start every post by informing us whether or not they are a lawyer.
