Well, I have 4 nights at a Holiday Inn Express this month....with 4 more to go so.....not a lawyer, but there's a solid chance I solve cancer, the Kennedy assassination, Hoffa's location, and the DB Cooper case in the next few weeks.

IANAL and I obviously wasn't there but the physical logistics of committing the alleged crime just don't seem possible to me.
Someone needs to get a whiteboard in court and draw this out... lol

I'm not a lawyer, but I played one in the movies:

At the Circus (1939)

J. Cheever Loophole : What's the best way to get back the $10,000? Offer a $15,000 reward.

Antonio Pirelli : You know what I think? The guy who hit Jeff on the head and knocked him out didn't like him.
J. Cheever Loophole : Now let's not jump to concussions.

J. Cheever Loophole : I'll grill her until she's well done! She must know something about this case.

IANAL but it is cold today.

Introduction

Petitioner, Texillwek, hereby moves the court for a temporary restraining order against Mother Nature, seeking immediate relief from the unreasonably cold weather conditions that have been plaguing the community. The following memorandum of points and authorities supports this motion.

Facts

  1. The temperature outside has been consistently below freezing, causing significant discomfort and inconvenience to the petitioner.
  2. The cold weather has led to hazardous driving conditions, making it difficult for the petitioner to travel safely.
  3. The petitioner's home heating system has been unable to keep up with the extreme cold, resulting in higher heating bills and inadequate heat.

Legal Argument

Negligence

Mother Nature, as the primary force governing the Earth's weather patterns, has a duty of care to maintain reasonable and safe weather conditions for the petitioner and the community. The excessively cold weather constitutes a breach of this duty, causing harm to the petitioner in the form of physical discomfort, financial burden, and emotional distress.

Public Nuisance

The cold weather, by its very nature, interferes with the public's right to use and enjoy public spaces. It has become an obstruction and interference to the petitioner's use of public roads, sidewalks, and other outdoor areas.

Private Nuisance

The cold weather has also become a private nuisance, substantially interfering with the petitioner's use and enjoyment of their property. The petitioner is unable to engage in outdoor activities or even leave their home without experiencing significant discomfort.

Relief Requested

The petitioner respectfully requests that this court issue a temporary restraining order against Mother Nature, enjoining her from continuing to subject the petitioner and the community to unreasonably cold weather conditions. Specifically, the petitioner requests that the court order Mother Nature to:
  1. Raise the temperature to a more comfortable level, allowing the petitioner and the community to enjoy outdoor activities without undue hardship.
  2. Improve driving conditions by melting any ice or snow that may be present on roads and sidewalks.
  3. Ensure that the petitioner's home heating system is able to adequately heat their residence, reducing the financial burden associated with higher heating bills.

Conclusion

In light of the foregoing, the petitioner respectfully requests that this court grant the temporary restraining order against Mother Nature, providing immediate relief from the excessively cold weather conditions.

I used to watch a lot of the Perry Mason shows when it was on , so I think, even though I am NOT a lawyer , that I have a good understanding that TSJ is innocent and should be reinstated immediately based on the fact that he is innocent of all charges and he should explore the premise of suing the accuser and the Douglas Co. DA for defamation of character.................

I really really do.....................

It was a damn good, reasonable read.

I appreciate it.
Agreed. There could be various ways this played out and one scenario is she could be mistaken on who did it instead of being a liar out to ruin the life of someone she's never met before.

I'd love to have a prosecutor chime in but if the DAs case is what is presented in probable cause affidavit, I can't envision most prosecutors bringing that case all given the evidence presented. I'm not opening on guilt or innocence but the weight of the evidence presented in that affidavit. It is of course possible the DA has additional evidence that we are not aware of and likely the defense would not have as of yet.

I have been having a whirlwind of emotions over the last day. The basketball fan in me is so stoke that theres a chance TSJ is back on the court. The father in me hopes that he is innocent because I would feel terrible cheering for someone who may be guilty of these charges. The skeptic in me thinks the case is a total sham and should be completely thrown out. The pessimist in me thinks there is more to the story and the DA has more evidence than we know of and she cannot be this inept. Right?

Seems impossible at this point, but was hoping to have the charges dropped resulting in TSJ's reinstatement.

thank God that Shannon has the means to afford excellent representation
This cannot be overstated enough. When you consider 12% of the people who have been sentenced to death row were later exonerated, and in those cases, close to 70% of those wrongful convictions were due to misconduct by police, prosecutors, or government pressure, not having the means to adequately represent yourself is a scary proposition.

For those who have the time, this is an excellent read. Moral of the story is, no lack of evidence, witnesses, or testimony will stop certain people in positions of power when they're pressing for a conviction. And the only hope you might have at that point is good council no matter how innocent you are. Truly sad stuff:

The Kennedy Assasination and the DB Cooper case remain elusive. As to Jimmy Hoffa…not sure where they buried him after they stole his DNA to clone him. (Exhibit A)

If you are triggered by me saying that people should better educate themselves about the different ways that sexual assault victims respond in different situations, and just because they didn't respond the way you think they should doesn't mean an assault didn't take place, then you are part of the problem.

And if me saying that upsets you, I really don't care.

I also want to point out that my original post was not making a statement as to what I think happened with TSJ. I hope that an assault didn't occur. But I don't know. None of us do. However, my post was making a general statement about how people respond to sexual assault (and sexual assault accusations).
As for how victims actually respond, you’re correct … but you’re speaking to ONE problem with tunnel vision and acting as if consideration for that problem is the only moral high ground you can claim here.

Meanwhile, it appears clear as day to 90% here that this case is a big pile of BS. Therefore there’s rightfully plenty of outrage toward the DA for the pain she’s caused TSJ based on how flimsy the evidence is (if you can even call it evidence).

You’re right that no one knows what happens. But if you go through mental gymnastics to be so ~pro-“victim”~ that you aren’t seriously entertaining the idea that this is effectively a false allegation and that SHANNON is the victim, you’re part of a different problem.

I had posted a question on why the accusers statement hadn't been redacted and released and cjw1901 answered it for me with the following:

"I asked Jordan Clark, who is a trial clerk working for Douglas County Circuit Court, about this topic on Wednesday, 1/3/2024. Even though he communicated with me previously, he had no comment, so far, on this topic of whether the probable cause affidavit has been released. This might mean that the court has been instructed not to comment on why this choice was made. I also asked why the information being release is limited in this way. So, Jordan Clerk seemingly had no explanation for that. It seems that this would be up to a judge in this case, not the clerk though, so Jordan Clark may have just been following the judge's decision on this matter."

I have a serious issue not releasing this. It is very disingenuous and seems like it was done to influence the court of public opinion more than anything. These are the hardest cases to actually prove and we're in a bar setting with a video camera and it took this long to indict. On top of that he was disciplined immediately. This is why he is filing a suit against Illinois and he will win. I think Illinois should put pressure on this prosecutor to release that information. If they don't reinstate him. There is no reason not to release that information other than it weakens your case or shows that you have a lack of a case.

Both the victims story along with TSJ's are out there now. So frustrating that it has come to this, should never have gotten to this point.

Responding to this post as I don't know that I've seen TSJs version of events.. where is that out there? Could someone point me in the right direction?

Again, my statement was not in reference to the TSJ situation. I still don't know why people are upset at a suggestion that people should better educate themselves.
