You can argue that TSJ will already severe a life sentence of sorts from this without conviction already.Kansas can define rape as they wish, but wow, a minimum of twelve years in prison for what TJ allegedly did?! I have trouble with that.
And going 1 mile over the speed limit is speeding by law.The law states what rape is - what’s being charged is non-consensual penetration via digits - that makes it the legal definition of rape (whether you believe TSJ is guilty or not). The logic presented in another example: if I don’t think smoking weed and driving is operating a vehicle under the influence - it’s not because I simply disagree with it.
Yeah because sexual assault is comparable to a minor traffic infraction that wouldn’t be enforced under any circumstances. Point of the post is - laws don’t magically not become laws bc we don’t agree with them. The charges constitute what the law says in Kansas. And people need to stop assuming that those of us who understand this think TSJ is guilty based on what we know. There are people on this board who know victims of SA and the dialogue by some is flat out offensive.And going 1 mile over the speed limit is speeding by law.
The line that separates rape from sexual battery is whether penetration occurred. If the DA can't prove that penetration occurred then they have to prove the alternate charge which is sexual battery.I don't know about that, it's listed as Count One (rape) or "Alternate" Count One (not rape)
That doesn't sound like they are clear on what he should have been charged with.

That situation is going to pan out however it's going to pan out and whenever it's going to pan out. Glad the hot takes are slowing down. It, rightfully, got enormous attention early on. Have to accept the fact that this is going to make it's way through the legal system and that's going to take a long while....while the season moves on.

More specifically, Kedric said the DNA evidence came back and “it wasn’t Tererence’s DNA,” which, if correct, would imply that there was someone else’s DNA found besides the accuser’s, just not TSJ’s.I learned some things listening to Kendrick and other callers today on sat sports talk. I did not know that zero DNA evidence was found on the victim. I didn’t not know that TJ volunteered himself prior to the charges for a DNA swab. I thought it was interesting that TJ had/has know idea of the identity of the person accusing him. Also, and lastly, I had assumed she was a KU student. She’s not. No conclusions, just a lot of details I hadn’t heard before.

Yes you can. In rape cases, no evidence is necessary other than an accusation. Additional evidence is helpful but not required. There is additional evidence in this case including video evidence both parties were in the bar at the same time. Also, a friend of the accuser confirmed that she told her about the incident before they left the bar. It's a he said, she said situation. I personally believe there is reasonable doubt, but the jurors could come to a different conclusion. TJ's life is in their hands unless the accuser stops cooperating.So again I ask. With that being said, I'm interested to see if TJ's team can locate the girl who supposedly TJ had his arm around while the incident occurred. Or if the guys he was hanging with saw the accuser and TJ together. Their testimonies could be helpful.
