We live in a country where people are innocent until proven guilty. NONE of us besides insiders maybe, really know what happened, what to the extent that things happened, his guilt or innocence. This isn’t about backing someone who is a r*pist or whatever, it’s literally defending someone’s innocence until it’s proven that he is guilty.

Terrence, the university, Whitman, etc. probably have a very good idea of what actually happened here, they obviously know Terrence’s character and from what the public knows about him, it’s all been extremely positive until a few weeks ago. If Terrence was truly guilty of such a crime, he doesn’t play the first 11 games or at all this year IMO.

Let the kid play, if something comes out or is proven that he indeed commit such a crime, dismiss him. But right now, he has EVERY right to be back on the team.

I hope this is the case. It just seems odd that Illinois ppl would encourage TSJ to sue them considering it seems Illinois ppl behind the scenes were trying to work with him to find a resolution.

But I don't know anything about the legal process or have any inside information. Hoping for some sort of signals from insiders 😃

Got it. Poor choice of words by me. Like I said, not a legal expert.

Was this the expected move here? Or is this a result of something not going well for him?

It is very possible (likely?) that people within UI support TSJ taking this route. We can't lose a PR battle if a court is the one deciding to let him play.
Could be brilliant. The tea leaves I am reading suggest that many close to TJ believe that he is either innocent (based on information they’ve been provided), and/or that this has been a railroad job by a disturbed DA looking to make a name for herself. Clearly she has some of her own issues going on….
Either way, I agree this takes the onus off of the UI, the panel, the AD, the team, etc and places it firmly on the courts.
If in fact TJ is innocent of these charges then this could be an excellent course of action to keep his basketball career moving forward.
If successful, it will also create a an environment whereas the opposing fan bases will have even more fuel for their fire.
Buckle up.
Here’s to hoping that eventually TJ is in fact innocent of these charges, and if so this will be the best possible outcome.

TRO’s 95% of the time are accepted, with a later hearing ~2 weeks from the initial date where it is seen in front of a judge. My guess is Terrence is reinstated for the time being effective immediately upon the university getting summoned the paperwork.

As I understand it, a judge won’t look at any evidence, but will consider the legal aspects. In this case, he or she will weigh whether the UI has the legal authority to withhold a person from athletic events while presumed innocent in a criminal case. It would not be a stretch for a judge to rule on the side of an individual. But my caveat: I’m not an attorney.

This hearing 2 weeks later decides on whether the restraining order can continue?

Even if this worked, wouldn't he still only be allowed to play home games until the case is resolved? AFAIK a condition of his bail is he can't leave town.
Can he get the court to order Brad to suit him up/start him/play a mandatory number of minutes? What if the school lets him practice but not play in games? Then what? Do we have demonstrators on game day outside of Assembly Hall, some for playing TSJ, some against the idea? What a potential PR nightmare.

This doesn’t feel as good as I think we hoped this could get figured out. I will be thrilled to get him back on the court ASAP. But if the charges are still a cloud over his head as he plays out the rest of the season, it will unfortunately be negativity we will have to face every gym we go into moving forward. I feel decently about his innocence, but the masses at large don’t know enough to believe that he might have been wronged in this situation.

Also, can the university really secretly support him doing this if it basically destroys the university’s policy it established for this type of situation?

BRILLIANT move by TSJ & his lawyer, handlers, and I’m sure some of the athletic department….. If I had to put money on it, Terrence is back in the lineup this Thursday. Chess move.

My initial reaction was, wow, a motion against the UI??? However, one usually never obtains justice from those that have harmed you, which is my reaction to those that have suggested a suspended and agenda-driven DA will have a change of heart. But as others have pointed out, this motion is a way to seek redress and maybe the only way, given the urgency and time constraints. We have not had details on panel process, but article states "citing lack of due process and lack of contact" suggests TSJ and his legal team were not part of the process (presenting their evidence or statements, etc).

I don’t think the official restrictions on his bail have been shared on this board

I think people who deal with these matters thought travel could be an issue. The judge probably doesn’t think he is a flight risk. Also sometimes judges only care about international travel. Again I haven’t read his actual legal paperwork. I doubt TSJ would do this just to play home games

Couldn’t it be ruled that holding him out without a legitimate reason would be in violation of the order if it is granted? You could look at his usage prior and argue the only change is the charge. Could be reading into it wrong though. Don’t think they would sit him if this goes through regardless given all the info that’s been provided.
