No it's not, and it's not even accurate. 4 years ago, Beard took Texas to the tourney and won a game in his first season at Texas. The year after he had a top 10 team that he was fired from. That team went on to make Elite 8 with a fill in coach that is likely going to be fired at the end of this season already.
I agree with what you are saying in that other forms of payment under the old system are still illegal, functionally they still serve the same purpose.

We share a common goal, we both want this team to win and make a strong playoff run. If they succeed this year, it could indicate that BU is building sustained success. However, another loss in the first weekend would only reinforce a troubling pattern. Even some of the greats have struggled to close out games, so while BU is a good coach, I have doubts about his ability to elevate the program to the next level.
Very true. NIL is a bit "wild west" right now, which is why a lot of people seem to think everything that was once verboten is now A-OK. I'm not sure Whitman will get exactly what he's proposing, and he may not get anything from Congress, but I have a feeling at some point, someone, somewhere, will at a minimum start trying to enforce the rules already in place (yes, there are actually rules in place!).
I believe Chris Beard has the potential to be a better coach, but I can't overlook the domestic abuse allegations. Even though he was acquitted, that police report was truly eye-opening. I also strongly oppose comparisons to the TSJ situation—TSJ was falsely accused of something he clearly did not do, with absolutely no supporting evidence, whereas there was evidence involved in Beard's case.

I just don’t see how you can enforce “fair market value” on NIL. We all have a reasonable idea of what that must be, but there’s nothing stopping, say, Twin City Radiator from deciding — for whatever reason — that one Dame Sarr autograph session for $1 million brings that level of value. In fact, if that’s what the marketplace commands, that becomes fair market value.
