But of it doesn't end in our favor (e.g. since the law was passed after the violation) then we are back to square one with the possibility of invalidating wins.

The best route is probably just to serve the suspension AND then sue the NCAA.

I’m sure Kofi, his advisers and the university have considered all angles and felt for whatever reasons that sitting out 3 games was the best approach to take. If it was as cut and dried as you make it sound, they likely would have gone the route you suggest. More likely is that it isn’t and there are some risks that weren’t worth taking. Kofi is back to improve his stock so he can get drafted as high as possible. Missing 3 early games is not likely to impact his goal. However, even if unlikely, possibly missing three conference games (which could impact tourney seeding and make success harder) or heaven for bid 3 tournament games have a much greater likelihood of impacting draft potential. Easy for fans to say “screw NCAA, fight it,” but Kofi needs to consider potential impact on his future even if chances of a negative impact are small.

Looks like Jay Bilas agrees with me in Dan's post below. He's saying the decision should go outside the NCAA. So, maybe it wasn't as cut and dry as you suggest, either.

Well...Illinois and Kofi could follow the Self-Wade approach and just deny everything and proclaim innocence even in the face of overwhelming evidence. Might be penalties for them sometime in the distant future. It appears to be a successful approach. Admitting guilt and making amends gets a fairly quick penalty. Whitman and Illinois took the high road.

I don’t think anyone is surprised by Bilas’s reaction. And my point was more that Kofi’s decision wasn’t cut and dried. He had to weigh everything and do what he feels gives him the best chance to realize his dream of being drafted/playing in NBA. Obviously he felt take the three games and then move on uninterrupted. Maybe he could have won appeal or trip to the courts. I just think it is easy as a fan or even Jay Bilas to say fight it when there is no skin in the game. I don’t think he should have been suspended, and if he had chosen to fight it I would have no problem with that either. Just as I have no problem with him taking the safer route.

The high road is the way to go. In 2 months, nobody is going to remember this. Better move on and not let this become an ongoing distraction.

Someone may have made this observation, but assuming the money was gone within days of the sale, where does the NCAA think Kofi is going to get the money? NIL. It seems to me this has elements of an NCAA temper tantrum for having lost the NIL litigation.
