As an investment banker, my firm pays me $50/month to "own" my cellphone. I have to save all of my texts, personal or otherwise, forever. Compliance can come into our office unannounced at anytime, and demand that I unlock my cellphone and then look through all of my "business" texts.

The good news is that Lawyers generally do not encourage individuals to make frivolous law suits because they do not want to waste their time (unless they have a deep pocket client to pay their fees) or they expect a "payday" when the favorable results are obtained. I can only assume that TSJ's lawyers expect to win!!

Well, the DA wanted this to be a high profile case. She got her wish .......and then some.
Idk whether he will win or not, but good for him to try. People need to push back when people in authority don't do as they should. I hope he wins but even if he doesn't it may help others see what a joke this was for the get go.

I've tried to get the prosecutors out of my mind as much as possible after TSJ was proven innocent (and I use those last two words very intentionally), but has there been any news on those misconduct charges?
Yes, I want her to suffer as much as possible. Being disbarred and being found liable in this case would add to the suffering, and I'd enjoy that quite a lot.

Based upon the evidence made public to date, I think it highly unlikely that TSJ could succeed. The judge found probable cause for the case to proceed. But the lawsuit will give TSJ the opportunity to go fishing and see what his lawyers can catch. There may be emails between prosecutors and police that will be available in discovery that could establish malice or corrupt motives.
There's a certain karma here to how they discovered malice with the accuser in texts and other communications -- could they go 2 for 2?
TSJ legal team has their work cut out for them as Douglas Co DA office clearly operates with high level of professional integrity....

At least you only have 1 phone. My investment firm requires a corporate issued phone that I have to conduct all business on. I have to certify every month that I did no company business on my private phone. So I have 2 phones with me at all times.

This is how it should be. Outside 9-5/work week, Use your personal phone. I do this now, except I don't work. But I do have a designated personal Cell Phone, and a designated 'everything else' phone. One number is my friends and family ONLY. The other number is everything else, it gets put on every application, every form, every 'win this or that raffle', every non-personal site/application/unknown instance that requires a phone number. 000-000-0001 doesn't work in many instances anymore.... I pay $5.00 extra per month for this number, and it is WELL WORTH IT!!!! It works for me....

I think you hit the nail right on the head. This case is going to rely entirely on discovery. I think it's a calculated risk though as this DA seems like the type of person to be so self-righteous that she'd actually be stupid enough to put extremely prejudicial and case compromising thoughts in writing because she believes she's Lady Justice.
And I could definitely see her sending messages of the nature of "I don't care there's not sufficient evidence, if he doesn't settle, he won't be able to play basketball as we'll just tell him we'll delay the trial until after the NBA draft so he has no choice but to settle because it would cost him millions not to. Charge him." Or messages regarding hiding the evidence that Morris was at the scene of the crime.
Had TSJs lawyers not also gone after the police in this case though, I thought there also might have been a possibility that some of the cops might've flipped saying that they were pressured by the DA to make a case against TSJ despite them repeatedly telling her that there was no evidence to support that and they didn't believe he committed the crime.
