What does it all mean, Basil?
My take is to expect a decision on the TRO fairly quickly. Judge appreciates that a TRO is an expedited emergency process so she superseded the likely docket auto-generated response date and set a hearing on the motion. My guess decision will be made within a week. If the TRO is denied, they can still move for a preliminary injunction. Difference mostly is whether an emergency restraining order is needed to avoid irreparable harm or whether parties can wait to to hold an evidentiary hearing on the preliminary injunction

I’ll have to go find my post where I asked if there was a world where TSJ sued Illinois. I was told no.

But I’m not a lawyer so I guess I said “sue” but I meant challenge that his presumption of innocence or duty process ir what we is being violated.

Some entities operate on “preponderance of the evidence” rather than not “beyond reasonable doubt”.
It's a lawsuit. It's a complaint seeking injunctive and declaratory relief, not money. The whole point of these suits is that money cannot remedy TSJ for the harm being done.

Some have commented on Judge Colin Bruce recusing himself. It is not uncommon for Judges to recuse themselves due to what may be perceived as potential conflicts of interest. Here, Judge Bruce is a U of I grad (undergrad and law), and I believe his brother is a former U of I Trustee.

Magistrate Judge Eric Long has also now recused himself.

Lawyer here. By asserting claims under Title IX, which is a federal statute, they gave UIUC the option to remove the case from state court to federal court. Federal courts have jurisdiction over cases that raise questions of federal law.

Very generally speaking, Federal judges are viewed as being more sophisticated and impartial than state court judges. I stress, that is a huge stereotype I am making; many state court judges are excellent and many federal judges are not. I am only offering that as a possible explanation for why UIUC decided to remove the case. No matter what we on a message board think, UIUC has an interest in defending its processes.

I believe that there is only one federal judge currently seated in Urbana. He is a BA and JD graduate of UIUC. Perhaps that has something to do with his decision to recuse himself. So, the case had to go to a judge outside of Urbana. It went to Judge Colleen Lawless in the federal court in Springfield. I know nothing about her besides what’s on her Wikipedia page. The reassignment process typically is random, so I don’t read anything into it.

Will be interesting to see what happens.
Regardless of the outcome, Judge Lawless is excellent. I would expect a detailed ruling from her and I would not expect it to take a long period of time.

Excerpt from TSJ's written statement to the panel:

That's why you seek a TRO. To limit the extent of the irreversible harm done by the current status quo. Because if you wait for the entire process to run its course to the very end the way things currently stand, TSJ will have been significantly harmed without sufficient recourse even if he is found not guilty.
Something people here won’t want to hear is that a mandatory injunction is a higher burden than one which just preserves the status quo.

Poorly designed zero tolerance policy that conflicts with title 9 vs high power lawyers chasing NBA salary level monies. I’m betting on the lawyers.

Worried that TJ and alleged victim are forgotten along the way.
High power lawyers from Oakbrook Terrace, Evansville and Champaign? 🤧

If the restraining order fails does that create precedent to destroy teams using criminal accusations knowing that “code of conduct” policies always error on the side of “zero tolerance.”

The rabbit hole that would create has the potential to really do horrible things to people and teams.
