The Court has moved up the hearing on TSJ's Motion for TRO to 1/12/24:

TEXT ORDER entered by Judge Colleen R. Lawless on 1/9/2024: This action is before the Court pursuant to Defendant's Notice of Removal on 1/8/2024. 1 Plaintiff Terrence Shannon Jr. filed this action in state court asserting various claims relating to his suspension from the University of Illinois men's basketball team after Plaintiff was criminally charged. Attached to the Notice of Removal is Plaintiff's Motion for a Temporary Restraining Order, Preliminary Injunction, and/or Expedited Discovery. [1-4] Defendants are Directed to file a response to the motion by 1/11/2024. A hearing on Plaintiff's motion is set for 1/12/2024 at 1:30 p.m. Counsel to appear by videoconference, the instructions for which are attached. (ED) (Entered: 01/09/2024)

Poorly designed zero tolerance policy that conflicts with title 9 vs high power lawyers chasing NBA salary level monies. I’m betting on the lawyers.

Worried that TJ and alleged victim are forgotten along the way.

i want him to have not done this and i want him to not face these charges but until such time as he is no longer actively being charged with a crime i do not want him to play for my alma mater's basketball team

this whole situation sucks. there's no easy answers.
I get it. I get both sides of people wanting him to not play and people wanting him to be reinstated.

Where are you seeing that her back was to him? The language isn't the most precise, but I think it suggests she was facing him: "the male used one hand to pull her towards him...the male's hand was around behind her".

To me, the weakest part of that account is that she "was not sure which hand" performed the assault. I imagine a defense attorney could make that seem like she couldn't possibly know it was his hand if she didn't even know which of his hands it was. That doesn't make him innocent, and (IANAL) doesn't necessarily mean there isn't enough to charge him.
Well, to be honest, I've read so many posts about this matter including what TJ's lawyers filed, and the Lawrence police report, news stories and all the "insider information" on boards like this that .I'm not sure where I even got that. If it's disinformation, I apologize. I still don't think there is enough to convict him, and I don't believe he should have his career/life ruined any more than it already has been UNLESS and UNTIL he is found guilty in a court of law.

IANAL, have never stayed at a Holiday Inn Express. But I am at my beach house and so am available pro bono for any issues that any may have.

I've kept up with the events and the conversations regarding TSJ. I'm not going to try and make sense of all the head spinning back and forth of all of this. I hope TSJ is innocent. I'm not excusing sexual assault, I just hope he didn't do it and that the accuser is mistaken.

You're missing the mindset of most in law enforcement that it's there job to gather evidence to support an arrest and close their case, not the other way around. You are giving way to much deference to the boys in blue. Anecdotal experience from a 1st degree murder case here in Central Illinois where the lead detective prepared no report detailing a conversation he had with my client's probation officer that he had a face to face meeting in their office, which just happened to be in California, and that was at a time of day where there was no way he could have been here at the time of the shooting.
I'm not sure average folks realize the day to day banality of some aspects of law enforcement and the legal system. Where people become cogs (or 'delta' and 'pi' in shorthand in file notes) and rushing to get a case to a prosecutor is the order of the day. Or slow walking if you don't want it to be charged. Plus you've got local unspoken rules and personal relationships and all the unconscious (or conscious) bias that occurs when day after day after day you only see the bad part of society and not the good, and it starts to color your overall worldview.

I would *never* have charged a case as flimsy as this. But I bet some prosecutors would, and have. I would have asked so many more questions, requested so many more follow-ups, and yes, I likely would have done it with the knowledge that this was not an 'ordinary' defendant, knowing full well that in other circumstances, again, prosecutors in the same position might not do the same due diligence.

Something ain't right here. And I hate to join in the speculation as much as anyone else but man...it's hard to defend anyone connected with the investigation and decision-making with regard to this criminal case.

You're not going to be able to top this: In Austin, Texas, (where I lived for 6 years) there is a noted urologist named Richard "Dick" Chopp who, according to his LinkedIn profile, "is well known in the Austin community for performing Vasectomies." Look it up.

Would it be reasonable/typical for the DA to have stronger evidence than they have made public so far?

Haven't been able to keep up with everything (working for a living sucks), so if someone has offered this already my apologies...but do we really think the University will care if TJ wins the lawsuit? Seems like the best case for the University, pleases the no tolerance crowd in that you tried to suspend him & let's you push out any decision while the legal process plays out where you don't run into the situation where you are punishing an innocent person.

I’ll have to go find my post where I asked if there was a world where TSJ sued Illinois. I was told no.

But I’m not a lawyer so I guess I said “sue” but I meant challenge that his presumption of innocence or duty process ir what we is being violated.

Some entities operate on “preponderance of the evidence” rather than not “beyond reasonable doubt”.
