Haven't found a published report, but Dan Bernstein on The Score says that another lawsuit filed by "John Doe 3" claims that Fitz witnessed hazing. Bernstein says he's read a copy of the lawsuit.
I found the third lawsuit. Not defending Fitz at all, but nowhere in the lawsuit is there a new claim that Fitz "witnessed the hazing". There are broad claims he was involved, but no supporting evidence included. The only actions stated is the "Shrek clap" and forcing players of color to cut their hair to fit "Wildcat way", which were all previously alleged. Then again, this source (Dan Bernstein) is hardly credible. I mean, he has never been known to exaggerate or blow things out of proportion before...

Yes, these are the broad claims I mentioned, that are not substantiated by any particular event. This is typical filler material in lawsuit claims. The claim you stated from Bernstein was that he "witnessed hazing". This is not anywhere in the material.

Now if there is evidence to be presented on these two points, then Fitzgerald is in larger trouble than just a civil lawsuit...

Tough to interpret the lines on that statement. Taking part can be easily interpreted as physically present during hazing, but the backdrop of that sentence could be what is already well-established, that Fitz did the clap during conditioning and the players carried out the action (with the plaintiff's arguing that clap is his part of the hazing). My initial read is the latter, as they would have a more blunt statement in the lawsuit if they prove Fitz was physically present during the abuse.

I’m a cynic in these matters of institutional firefighting.

Same. Seen this movie too many times. So many scandals, and so many head-scratching punishments after bringing in consultants to "investigate". The real reason, we keep seeing, is to CYA and reduce the liability to victims. Seems the people in charge are able to spend a lot of organizational money to try and keep their jobs.

This continues to look like it will get even worse and worse before it gets better for Northwestern.
