I’m pissed off man. Trying to be as sensitive as possible to the situation but man it seems like the way Kansas Law has handled this is a complete joke
I did not watch and only read the summary, and this makes much more sense (talking in general re: process). But my questions remain as to process and what and how panel get info.JW explicitly said in the press conference that the panel can re-evaluate the decision any time new information becomes available.
Your black-and-white view of a complex situation with the most important details missing to all of us and your expectation to find unbiased opinion on an Illinois sports message board are naive at best. You are making just as much of an uninformed judgment against TSJ (and others) as the unreasonable (in your opinion) bias in TSJ's favor that you describe. If you were not expecting a bunch of Illinois fans to be in passionate disbelief that our best player is in this position and were looking for spirited & unbiased debate on the law in Kansas, you came to the wrong place.I have read the entire message board after the initial suspension and up to this post, read what has been said. I believe it sad at how there is a "belief" that the legal system is corrupt or a victim coming forward is immediately doubted. I keep reading how great of a human TSJ is (which is reasonable). Meanwhile people Google a DA and immediately start hammering home how off kilter she is. I can appreciate the loyalty to Illini sports but I think people need to take a step back and really think this through. After watching/listening to JW speak I believe one of one of two things, either TSJ withheld details and they took him for his word OR details were divulged and JW&CO decided that money and success were more important than setting a standard meanwhile hoping this would blow over.
TSJ shouldn't be allowed to play again for the U of I unless he is completely acquitted of all of charges. Plain and simple. As a man, father, and brother there is ZERO tolerance for this. From a misdemeanor to a felony. . . .zero tolerance.
Lawyers, please help me out. Is it common to be charged with a felony and/or a misdemeanor in these types of cases?
Josh said that when he became UI AD, he saw what had happened at other schools and decided he didn’t want that to happen at Illinois. And that’s why he set up the panel. MOST other universities DON’T have a procedure set up and when things happen, the improv and the result usually isn’t very funny.I'm guessing that the assessment/punishment system JW put in place represents current best practice among top universities. As such, I would expect similar structure/process/policies at other schools. This generally-accepted approach would somewhat insulate these institutions from accusations of "homer" or other bias and accelerate the post-decision healing.
Anyone have any informed insight on how the rest of the world is set up to handle this kind of stuff? Are we a leader? An outlier?
I dont believe youYou guys all know I’m not really Bryce Hopkins, right?
Yes, I have Richards pic in my profile and everything. I also know his favorite color.Serious question though: is Richard Keane’s Cousin really Richard Keane’s Cousin?
I laughed out loud on this one.I think he might really be Kendall Gill’s Uncle or maybe Deon Thomas.
My friend, yes, sexual assualt is deplorable and I condem it completely.People really shouldn’t talk about broad societal issues, especially ones as serious as sexual assault, solely on the basis of their personal experience.
I can’t believe that this still needs to be said, but regardless of what happens with TSJ, the percent of false accusation of sexual assault is exceedingly small.
If said, offense took place in a public place in a bar with other people around, wouldn’t it be pretty easy to gather witness statements to say whether it really happened and whether it was consensual or not?
Wrong. They will if there is new information to consider.Refraining from speculation and focusing on panel process (and strategy): from Werner's article https://247sports.com/college/illin...llinois-fighting-illini-basketball-224171267/
"What’s next
First, once panel decides, the panel will not re-convene at any point. Not a lawyer and have no idea how panel process works. This and other articles do not indicate how or what evidence is considered/presented. Am guessing defense and panel have not had discovery and do not have the prosecutor's evidence. Do not know if defense can submit evidence to panel. Depending on process panel may only have warrant/charge and does not have enough info to lift suspension (would not expect LPD or DA to be prompt in discovery requests). Given Preliminary Hearing is Jan 18 and much more info will available, it could make sense to request a delay and convene the panel Jan 18 (or when panel would have requisite info to evaluate).
- Within 48 hours of Shannon’s suspension, a three-member Conduct Panel — ...— must review the suspension and make a decision of whether to uphold or lift the suspension. ... Shannon can waive the panel review or request a delay in the convening of the panel.
- If the panel upholds the suspension, the suspension will hold until legal resolution of Shannon’s case. Shannon’s first court appearance is scheduled for Jan. 18 at 3 p.m. in Douglas County, "
I said it in the previous thread and I'll say it again: it's not fight or flight, but really fight, flight, or freeze. Some people freeze instinctually instead of fighting. A lack of a scene isn't any kind of evidence for the defenseIf said, offense took place in a public place in a bar with other people around, wouldn’t it be pretty easy to gather witness statements to say whether it really happened and whether it was consensual or not?
I mean, Kansas defines the "inappropriate touching" you're describing as felony rape (FYI, the federal rape definition would also cover this). That's why the DA was talking about it that way. And at this point, none of us know enough facts about the situation to say it's simply a "he said, she said". We have no idea what physical evidence exists. We have no idea who all the witnesses may be. We have no idea if there is video. We have no idea if there is communication between TJ and the accuser. I sincerely hope TJ didn't do this. I'd love for him to be able to play for the team again this year. But people on here are making a LOT of assumptions based off of the very little information any of us actually know supplemented by internet rumors. My further zeal is being compounded by a Kansas DA that was talking about felony rape(as did every news outlet, TSJ will never recover) and now what we're hearing is that it was innappropriate touching in a very public place. Even the innappropriate part is a "he said, she said". Unfortunately the court of public opinion has already read the headlines and the worst case scenario has been etched in their minds.
Loren Tate just said on the radio that Bill Self is doing everything he can to help TSJ.
No way! Really?Loren Tate just said on the radio that Bill Self is doing everything he can to help TSJ.
There are 2 witnesses listed on page 2 of the formal complaint. One appears to be a nurse.Apparently not as there was hundreds of people there and they can't find even one witness. I've seen comments such as "well it was probably really dark in there" or "it could've been too loud to overhear a scuffle or argument". Well, come on... A man is forcibly raping a girl in a public place and as a juror if there's not one single witness, reasonable doubt begins to seep in. I'm sure out of 12 people, I wouldn't be the only one to . If there is some nuance to the story where the girl was isolated to a storage room or something like that, then the situation becomes more believable.

A witness can be a person that says “yeah she told me he did it.” Doesn’t mean they saw the event. There are 2 witnesses listed on page 2 of the formal complaint. One appears to be a nurse.
I have yet to see a headline calling him a rapist... everything I've seen says something about a rape charge or being charged with rape. I'm not sure what else you want them to say. That's the crime he is charged with in Kansas. If TSJ is cleared of all charges, he should never say a word to our local press that had to get the clicks and views by posting Rape everywhere. Why did they just go right to besmurchment.. they could have used alleged in the headlines at least.
